Foreclosure Process

  • The lien holder must begin action to enforce the lien within one year of the work's completion or the mechanic's lien is unenforceable. 
  • A notice of lis pendens should be filed with the county recorder. 
  • A foreclosure proceeding is held and heard before the Court and upon completion of the same and order by the Court, the foreclosure sale is held. 
  • Priority is based upon the date of the first visible improvement to the property.
